TERMS OF SERVICE

Payment Schedule   

The session will begin at the listed date and time, and will continue for the number of hours purchased. The date & time of this session will not be secured and no services will be performed until Payment in full has been submitted.

Cancellation & Rescheduling Policy  

Cancellations and rescheduling for any reason, including sickness or rescheduling of the Client's guest(s) are subject to the below terms: 

NEOCLASSIQ LLC, D.B.A. SF Podcast Studio has a non-cancellation or rescheduling period of 7 days before the session date and time. Notice of a cancellation or rescheduling of the Client's session must be sent to hello@sfpodcast.studio for documentation at least 7 days prior to the scheduled date and time of the session as listed above, and confirmation of receipt will be sent back via email to reschedule or cancel your session. 

  • If the session is rescheduled prior to the 7-day period, then the date of the session will be adjusted to the requested time if it is available based on our existing studio calendar.

  • If the session is cancelled prior to the 7-day period, a 50% refund of the contract total less taxes and processing fees will be issued to the Client less taxes, booking fees, or additional expenses that are expressed in the prior Invoice, and shall have no further liability with respect to the Agreement

  • If the session is cancelled or rescheduled within the 7-day period, then the full balance of the contract will be retained by the NEOCLASSIQ LLC with no refund or payment due to the Client, due to the high probability that the NEOCLASSIQ LLC will not be able to further book that date.

Online Delivery & Storage

The uncut video and audio files from the session will be delivered via an online downloadable link within 3 business days. The client's files will be stored for 14 days after the date of delivery, and afterwards will be deleted from our storage. It is the Client's responsibility to download their files within this 14-day period to retain their files. If the Client requests a file transfer after this 14-day period and we still have your files in our archive, an Archival Retrieval Fee will be charged to the Client for the process of accessing and uploading your files from our archive. However, it is not guaranteed that we will still have your files.

Failure to Perform

Due to the limited and subjective nature of the event, the NEOCLASSIQ LLC cannot be held responsible for requested images not taken or missed. NEOCLASSIQ LLC is not responsible for the lack of coverage due to scheduling complications due to lateness of individuals. NEOCLASSIQ LLC and/or their subcontracted individuals will do their best to fulfill all requests but can make no guarantees all images will be delivered.

Force Majeure

If the NEOCLASSIQ LLC or its assigns cannot perform this Agreement in the event that all photographic or audio materials are damaged, lost through camera or audio capture malfunction, or otherwise lost or damaged without the fault on the part of the NEOCLASSIQ LLC, then the NEOCLASSIQ LLC shall return any moneys paid by the Client, less taxes, booking fees, or additional expenses that are expressed in the prior Invoice, and shall have no further liability with respect to the Agreement. The limit of liability for a partial loss of originals shall be a prorated amount of minutes of video recording lost based on the percentage of the original recording time.

Copyright

All images and audio recordings created by NEOCLASSIQ LLC, D.B.A. SF Podcast Studio are copyrighted and remain the property of the NEOCLASSIQ LLC unless the client has purchased the copyright under this contract. If the client would like to purchase the full copyright/intellectual property of the images and audio recordings created under this contract for exclusive usage, they can request to do so, and SF Podcast Studio will not use any images or audio created under this contract for any purposes whatsoever.

Client Usage

The Client herby has full usage and editing rights to all images and audio recordings created under this contract for any purposes perpetually, without time limit. The Client may alter, re-purpose, publish, and monetize the images and audio created however they deem appropriate, without restriction.

SF Podcast Studio Usage

NEOCLASSIQ LLC may use images without the audio in clips no longer than 5 minutes created under this contract for general advertising, website portfolio, and social media examples.

NEOCLASSIQ LLC will not use, re-purpose, or monetize the images or audio created under this contract for any other purpose than listed above. If there is any part of the images or audio recordings captured in the session that the Client would not like us to use in general advertising or portfolio examples, it is the Client's responsibility to communicate this to NEOCLASSIQ LLC, and we ill not use those sections of the audio or video recordings.

Stills Photography Disclaimer

Still photography may also be taken during the session to use for portfolio website and social media purposes. It is the Client's responsibility to opt-out of still photography capture if them or their guest would not like to participate, and if so, will be detailed in the final contractual agreement.

Security Camera Disclaimer

Security cameras have been installed in the common area/staging room and inside the podcast studio room to protect the premises from theft and to enhance the personal safety of the Client, guests, and employees. These devices are used for the sole purpose of monitoring the conduct of persons who may cause such damage, and are not used for any other purpose. Recording devices in bathrooms or dressing rooms are strictly prohibited.

General Studio Rules

  • No smoking in the building.

  • No animals are allowed except for service animals.

  • Outside catering is allowed.

  • Consumption of alcohol must be approved by NEOCLASSIQ LLC in writing.
