TERMS OF SERVICE

Payment Schedule 

The session will begin at the listed date and time, and will continue for the number of hours purchased. The date & time of this session will not be secured, and no services will be performed until Payment in full has been submitted.

Cancellation & Rescheduling Policy 

Cancellations and rescheduling for any reason, including sickness or rescheduling of the Client's guest(s), are subject to the following terms: 

  • If the session is cancelled more than 7 days before the scheduled start time, the full contract balance, less taxes and booking fees, will be returned to the Client.

  • If the session is cancelled within the period of 7 days to 48 hours before the session start time, a 50% refund of the contract total, less taxes and processing fees, will be issued to the Client less taxes, booking fees, or additional expenses that are expressed in the prior Invoice, and shall have no further liability with respect to the Agreement.

  • If the session is cancelled within 48 hours of the scheduled start time, the full contract balance will be retained by the NEOCLASSIQ, with no refund or payment due to the Client, given the high probability that the NEOCLASSIQ will not be able to book that date again.

Notice of a cancellation or rescheduling of the Client's session must be sent to hello@sfpodcast.studio for documentation, and confirmation of receipt will be sent via email to proceed with the cancellation. 

Session Completion and Extensions

Nearing the end of a recording session, the NEOCLASSIQ staff have the right to interrupt the recording to inform the client that the session will end. NEOCLASSIQ and its staff reserve the right to decline any request for a session extension without providing justification. Please note that extending a booking on the spot is at NEOCLASSIQ's sole discretion and is subject to availability. In the case that there is flexible time after the Client's session and the Client would like to extend their recording time, the Studio Engineer will notify the Client how much recording time is available, and this additional time will be invoiced separately and will be required for the Client to fulfill in order to receive their audio and video files from that session.

Day-Of Studio Session Requests

The Client's session details, such as the number of guests, selected studio, mic choice, etc., must be pre-selected before the day of the session so that the studio engineer can properly prepare. We will do our best to accommodate any day-of requests from the Client, but we cannot guarantee we can incorporate all requests if they would hinder other sessions that day. If the Client requests last-minute adjustments, the Client understands that these changes will be implemented within their purchased recording time and that their recording time will not be extended beyond the purchased time slot.

Online Delivery & Storage

The uncut video and audio files from the session will be delivered via an online downloadable link within 3 business days. The client's files will be stored for 14 days after the date of delivery, after which they will be deleted from our storage. It is the Client's responsibility to download their files within this 14-day period to retain their files. If the Client requests a file transfer after this 14-day period and we still have your files in our archive, an Archival Retrieval Fee will be charged to the Client for accessing and uploading your files from our archive. However, we cannot guarantee that we will still have your files.

Failure to Perform

Due to the event's limited and subjective nature, NEOCLASSIQ cannot be held responsible for requested images that were not taken or missed. NEOCLASSIQ is not responsible for the lack of coverage resulting from scheduling complications caused by individuals' lateness. NEOCLASSIQ and/or its subcontractors will do their best to fulfill all requests, but cannot guarantee delivery of all images.

Force Majeure

If the NEOCLASSIQ or its assigns cannot perform this Agreement in the event that all photographic or audio materials are damaged, lost through camera or audio capture malfunction, or otherwise lost or damaged without the fault on the part of the NEOCLASSIQ, then the NEOCLASSIQ shall return any moneys paid by the Client, less taxes, booking fees, or additional expenses that are expressed in the prior Invoice, and shall have no further liability with respect to the Agreement. The limit of liability for a partial loss of the original recording shall be a prorated amount of minutes of video recording lost, based on the percentage of the original recording time.

Liability‍

NEOCLASSIQ is not responsible for any damage, injury, or loss of property that occurs during a recording session booked through our platform. Users agree to indemnify and hold harmless NEOCLASSIQ, its officers, directors, employees, agents, and affiliates from any claims, damages, or losses arising from the use of our services.

Use of External Equipment and Operators‍

Unless otherwise agreed upon in writing by NEOCLASSIQ prior to the session, the use of external equipment and/or third-party equipment operators is not permitted in NEOCLASSIQ studio spaces. All recordings and operations within NEOCLASSIQ studios must use the provided in-house equipment and staff. Any unauthorized use of external equipment or operators may result in immediate termination of the studio session, with no refund provided, and potential liability for damages incurred.

Respectful Conduct Policy

We are committed to providing a safe and welcoming environment for our team and clients. We reserve the right to refuse, suspend, or terminate services without refund if any client or their guests engage in sexist, discriminatory, harassing, or otherwise abusive conduct toward our staff or others on our premises.

Copyright

All images and audio recordings created by NEOCLASSIQ are copyrighted and remain the property of NEOCLASSIQ unless the client has purchased the copyright under this contract. If the client would like to purchase the full copyright/intellectual property of the images and audio recordings created under this contract for exclusive usage, they can request to do so, and NEOCLASSIQ will not use any images or audio created under this contract for any purposes whatsoever.

Client Usage

The Client hereby has full rights to use and edit all images and audio recordings created under this contract for any purpose, perpetually and without time limit. The Client may alter, re-purpose, publish, and monetize the images and audio created, however they deem appropriate, without restriction.

SF Podcast Studio Usage

NEOCLASSIQ may use images from clips created under this contract, no longer than 5 minutes, without audio, for general advertising, the website portfolio, and social media examples. NEOCLASSIQ will not use, re-purpose, or monetize the images or audio created under this contract for any other purpose than listed above. If there is any part of the images or audio recordings captured during the session that the Client does not wish us to use in general advertising or portfolio examples, it is the Client's responsibility to notify NEOCLASSIQ, and we will not use those sections of the audio or video recordings.

Stills Photography Disclaimer

Still photography may also be taken during the session for use on the portfolio website and social media. It is the Client's responsibility to opt out of still photography capture if they or their guest does not wish to participate, and any such opt-out will be detailed in the final contractual agreement.

Security Camera Disclaimer

Security cameras have been installed in all studio and lounge rooms to protect the premises from theft and enhance the personal safety of the Client, guests, and employees. These devices are used solely to monitor the conduct of individuals who may cause such damage. Recording devices in bathrooms or dressing rooms are strictly prohibited.

General Studio Rules

  • No smoking in the building.

  • No perfumes, cologne, scents, or aerosol sprays in the recording rooms.

  • No animals are allowed except for service animals.

  • Food is allowed in the Lounge Room but is not permitted in the recording rooms. For catering and food deliveries: please have the food delivered to the front door, and DO NOT share our door code with the delivery person, thank you.

  • Consumption of alcohol must be approved by NEOCLASSIQ in writing.

  • In-Person "Audience Member" Attendees‍: Unless otherwise agreed upon in writing by NEOCLASSIQ prior to the session. The Client may bring a party of up to four people, i.e., "Audience Member" attendees, into the studio suite, in addition to the people in the recording session. If the Client brings a group of more than four Audience Members, the excess individuals will be asked to leave the premises, as we cannot host this many people in our studio suite.
