TERMS OF SERVICE
Online Delivery & Storage
The files will be delivered via an online downloadable link within 3 business days. The client's files will be stored for 14 days after the date of delivery, and afterwards will be deleted from our storage. It is the Client's responsibility to download their files within this 14 day period to retain their files. If the Client requests a file transfer after this 14-day period and we still have your files, a Late Download Fee will be charged to the Client for the process of accessing and uploading your files from our archive. However, it is not guaranteed that we will still have your files.
Payment Schedule
The session will begin at the listed date and time, and will continue for the number of hours purchased. The date & time of this session will not be secured and no services will be performed until the non-refundable 50% security deposit has been fulfilled in Payment 1. Included in Payment 1 are any other listed costs for the session as listed above, including studio rental costs or parking costs for Mobile Podcasting Sessions. Payment 2 is due upon the date of the session, before the listed time.
Cancellation / Refund Policy
For a change of date and time or session cancellation, SF Podcast Studio must be notified at hello@sfpodcast.studio at least seven days prior to the scheduled date of event via email for documentation. If an email is sent more than seven days prior to the event, a confirmation of receipt will be sent back by SF Podcast Studio in writing via email to cancel your session and no further payment will be due, and the non-refundable deposit will be kept.
If the event is cancelled within seven days of the event date, the client shall pay the full balance of the contract with the second payment due upon the scheduled date of recording, due to the high probability that the SF Podcast Studio will not be able to further book that date & time. This includes cancellation for any reason including sickness or rescheduling of the Client's guest(s).
Failure to Perform
Due to the limited and subjective nature of the event, SF Podcast Studio cannot be held responsible for requested images not taken or missed. SF Podcast Studio is not responsible for the lack of coverage due to scheduling complications due to lateness of individuals. SF Podcast Studio will do their best to fulfill all requests but can make no guarantees all images will be delivered.
Force Majeure
In the event that all photographic or audio materials are damaged, lost through camera or audio capture malfunction, or otherwise lost or damaged without the fault on the part of SF Podcast Studio, then we shall return any moneys paid by the Client, less the booking fee, taxes, or additional expenses that are expressed in the Project Invoice, and shall have no further liability with respect to the Agreement. The limit of liability for a partial loss of recordings shall be a prorated amount of the recording time lost based on the percentage of total session run time.
Copyright
All images and audio recordings created by SF Podcast Studio are copyrighted and remain the property of the SF Podcast Studio unless the client has purchased the copyright under this contract. If the client would like to purchase the full copyright/intellectual property of the images and audio recordings created under this contract for exclusive usage, they can request to do so, and SF Podcast Studio will not use any images or audio created under this contract for any purposes whatsoever.
SF Podcast Studio Usage
SF Podcast Studio may use images without the audio in clips no longer than 90 seconds created under this contract for general advertising. SF Podcast Studio may use both the images created and audio captured in clips no longer than 90 seconds under this contract for website portfolio and social media examples.
SF Podcast Studio will not use, re-purpose, or monetize the images or audio created under this contract for any other purpose than listed above. If there is any part of the images or audio recordings captured in the session that the Client would not like us to use in general advertising or portfolio examples, it is the Client's responsibility to communicate this to SF Podcast Studio, and we will not use the images or audio within the corresponding timestamps for any advertising or portfolio materials.
Still photography may also be taken during the session to use for portfolio website and social media purposes. If you or your guest would like to opt-out of still image capture, please let us know and we will refrain from capturing any still images during the session. We respect you, your guest’s, and your company’s privacy and will do our very best to honor that in how this content is captured and used. If there is any additional clarity needed, please do not hesitate to reach out and we will do our best to accommodate you.
Client Usage
The Client herby has full usage and editing rights to all images and audio recordings created under this contract for any purposes perpetually, without time limit. The Client may alter, re-purpose, publish, and monetize the images and audio created however they deem appropriate, without restriction.
Security Camera Disclaimer
Security cameras have been installed in the common area/staging room and inside the podcast studio room to protect the premises from theft and to enhance the personal safety of the Client, guests, and employees. These devices are used for the sole purpose of monitoring the conduct of persons who may cause such damage, and are not used for any other purpose. Recording devices in bathrooms or dressing rooms are strictly prohibited.
General Studio Rules
No smoking in the building.
No alcohol is allowed.
No animals are allowed except for service animals.
Outside catering is allowed.
